We are surprised at your comment, since our contractor and temporary worker care program is seen as one of the best of its kind. We would hope you would wait to make any judgement on Berry Technical until you had had first hand experience rather than believe in hearsay. Your employer has chosen Berry Technical to manage the relationship with a group of agencies and contractors and temporary workers. This arrangement will give them better control, economies of scale and administrative savings. We have advised them not to allow any of the contractors or temporary workers affected to opt out of the process since, if one takes this course, then all would expect to be able to.
We believe that Berry Technical can provide you with an excellent service. Your employer has told us that they do not intend to continue to use your services in the present manner and will not encourage anybody to opt out of the process. The old adage that no-one is indispensable may well apply in this situation, since your employer is keen to achieve the benefits that these new arrangements will bring.
We need to review your present contract against your employer's standards; we will do our best to accommodate any particular clauses that are important to you, while protecting your employer’s interests above all else.
Our understanding is that your employer will transfer those contracts to Berry Technical - that is the contract and its obligations will transfer to Berry Technical, so continuing with it as it is is not an option.
We understand that your agency is not necessarily keen on these new arrangements but your employer has stated very clearly by letter to your present agency that it intends to implement this new arrangement. Berry Technical is undertaking discussions with your agency to effect the transfer of your contract and to minimise any loss they think they may suffer. If we are unable to come to an agreement with them, however, we will be advising your employer of a range of options, one of which will be to terminate the contract - but we don’t believe that it will come to that.

Berry Technical is responding to a need identified across the whole of your employer's company, whereas contractors and temporary workers are being bought from many different suppliers at vastly differing rates and terms & conditions. Your employer can see large savings accruing from migrating all of its contractors and temporary workers under Berry Technical as the managed service provider, thereby achieving consistent terms and rates and receiving only one invoice from Berry Technical and one point of contact for those workers. Berry Technical is implementing that solution and we believe that we will provide at least as good a service as you have been used to from other suppliers. Your employer is also very aware that they need to be fully compliant which is why they have decided to work with Berry Technical.
That would largely depend on when the new phase of the system will be implemented. If this is only one or two months away then that course of action may make sense, but we would need to agree that. If the next phase is several months away from implementation then it would seem to us that your contractor is not likely to be as key to its success in those circumstances and we would advise that we do not delay the migration of his contract in that scenario.
We have every expectation of providing an excellent service to both yourselves and the contractors and temporary workers involved, based on experience and our quality customer and contractor/temporary worker care systems.
Local arrangements of this type are, in our experience, ideally left to the local manager and the contractor; our maxim within these circumstances is "if it ain't broke, don't fix it".
We believe so, but have little way of knowing the level of service that you are used to receiving. What we can promise is that the account management and contractor and temporary worker care programmes that we work to are of the highest standard and, in our experience, after a short period of concern things settle down very quickly. Often we find that the present service is not as good as it could be and, within a short time, we are being recognised for adding quality to the process.
In our experience only about 10% of the contractors and temporary workers will have any concerns; most will be happy to trade through Berry Technical. Its worth remembering that contractors and temp workers often register with a number of agencies, sometimes as much as 50. Their overriding criterion is whether they will be paid the right amount and on time and on that score there is absolutely no anxiety among contractors and temporary workers about Berry Technical's payment process which achieves accuracy levels exceeding 96%.
